Originating from Hong Kong, The presale system of real estate has greatly promoted the rapid development of the real estate since its introduction to mainland .Meanwhile, because of the behind law system, the non-malicious, fraudulent behaviors of the developers appear endless. In recent years, the state's policies controlling on the real estate is issued in large number, due to rising prices and so on.But among the numerous comments and measures, there are few regulations from the perspective of Legal Regulation reflecting the disclosure of information of developers. Then,the paper analysis Comparatively the two law on obligations to disclose information .On this base ,it explains the inadequate factors of information disclosure system in China.They draw on the results of the comparative analysis of China's legal system .Later; it shows that such behaviors of the information disclosure as advertising distortion, model Housing, omission of information to provide a basis in reality. on the basis of the above analysis, it draws a reference of drugs brochures to pre-sale brochures market system and further to deepen the definition of fraud and misleading. strengthening its legal obligation to information disclosure of developers makes a normal operation of the information disclosure system, providing legal protection.This paper has these following innovations. First, it uses Game analysis and valuation of real estate way to the law explains and put out the brochures of real estate presale. Learning from advanced foreign practices, it redefines the Concept of fraud and misleading, regarding they are in the same line.
