Presale of real estate refers that the real estate developer is presaling the real estate which is under the construction.Presale of real estate not only solves part of sources of funds for the developers,but also meets the expected benefits of building vendee.However,when the buyer signed the contract of presale of real,he will expect to achieve ownership of the house,.because presale of real estate is based on the prem ise of design or construction of housing,for housing information,developers are in a do minant position.Du e to asymm etry of information,economic strength,and so on,developers can use false advertising to infringe the buyers' rights and interest s.This paper focus on the problem of presale of real estate in our country,and find out the reasons,put forward corresponding legal countermeasure,in order to strengthen the protection of the buyer,and promote the orderly normal development of the real estate economy.In this paper,besides introduction and conclusion,is divided into three parts.The first part is the summary of the buyer's rights in the presaling of the real estate,in order to deepen the understanding of the rights of the buyer;The second part is mainly the protection of the buyers in Chin a;The third part is the Suggestions of perfecting our country's commodity house opens to booking a protection of the rights and interests of the buyer,the part in the previous sections,on the basis of the results of the analysis,combined with our country's basic national conditions,puts forward some perfecting Suggestions.
