Research On Human Rights Protection And Death Penalty System

With the rising of modern human rights movement,"Human Rights"is gradually ruled as an international regulation. Human rights Protection is becoming a common requirement,death penalty once becomes one of the critical issues attracting world-wide attention. The appearance and development of death penalty system has its theoretic origin,among which the concept of human rights protection penetrates every aspect of death penalty system,the human rights protection of defendants,victims and witnesses is becoming an unavoidable problem in modern death penalty system.In recent years, Russia is devoting positively to joining to European Union organization and maintain consistently with European Union on the death penalty and regulation. Therefore Russia has carried on the comprehensive reform of its death penalty system and pay attention to human rights protection. Russia has an intimate contact with China in politics,economy and culture. Chinese legal system,especially criminal law is deeply influenced by former Soviet union. Although China has made great effort in human rights protection of death penalty system,it still needs perfecting.This essay analyses the theoretic basis and the status quo of death penalty and human rights protection from the angle of Chinese and Russian death penalty system,and discusses the ways to strengthen human rights protection in death penalty along with the related suggestions and measures.
