Constitutional Obligation Of Citizens

The relationship between citizens and state has been the impotern part of the politics and legal science research in western nation since the ancient times. The relationship between citizen's constitution obligation and right corresponds to the relationship between duty and right ,is a part of the relationship between citizens and state. Citizen's constitution obligation and right is the most basic and most important ones. To research of the citizen and national relations , we must grasps the Natural law theory and Social contract theory.As a result of historical reason , rights standard and obligations standard develops in turn. Which one is the most importarn one ,rights or obligations ? It is the focal point of law scholarly research. Although there are very few people are engaged in the research of citizen's constitution obligation, but the theory on citizen's constitution obligation is vital significance. This is the objective why I write this paper .The full text has about 35000 words and is divided four chapters. The main contents of all chapter are summarized as follows:Chapter one , constitution is the Social contract between citizen and states. As the main body of constitution relations , citizen and state will fulfill the duty and enjoy rights simultaneously. The relationship between citizen's constitution duty and state, rights, constitution standard , explay the significance of constitutional obligation of citizens.Chapter two , mainly discuss that if the national establishment is the results of Social contract evaluation between citizen and state. We must regards right and duty equally. Chapter three , citizen have to obeys the country obligationally. This is originally to the endurance of national mechanism which is the originally to the citizen constitution obligation.Chapter four, contrast the difference of constitutional obligation of citizens between west and east, and reconsidering the rationality of citizen's constitution obligation in China.
