A Comparative Research On Legal Supervision On Social Insurance Funds Investment

By the end of late August 2006, the social insurance funds have amounted to 230 billion Yuan. However, as the amount of the social insurance funds rises, the risks of the social insurance funds investment get higher and higher. Once the risks happen, the treatment of the people who are benefited by social insurance funds can not be realized, and the stability of the economy and the society will be influenced. In the year 2006, a series of cases concerning social insurance funds reveal that the legal supervision of social insurance funds investment in our country is not so well. So it is urgent to establish legal system of reasonable and ideal social insurance funds investment.The thesis uses the developed system of legal supervision of social insurance funds investment, especially the pension funds for reference. What's more, I am determined to design a mode for investment in social funds which can realize the goals of giving the market freedom and restrict the power of the government, so as to contribute to the formulation of the law concerning social insurance funds supervision.This thesis is divided into three parts. The first part is about the fundamental theory of supervision of social insurance funds investment, such as the causes, characteristics and principles of supervision. The second part uses the method of comparative research and take the supervision of pension funds as an example to study the supervision of social insurance funds investment, which can help us build a system for the supervision of social insurance funds investment in our country. The third part concerns about how to raise a completed legal supervision system of social insurance funds investment. The third part is divided into two parts. Firstly, from the perspective of the existing legal system of the supervision of social insurance funds in our country, it discusses the shortcomings of the law about investment. Secondly, I use the other countries' experience of the social insurance funds investment for reference, then analyze and construct the legal supervision of the social insurance funds investment in our country to a deep extent.
