Studies On Procedural Rules Of European Union Anti-subsidy Law

Trade between European Union and China increases speedly recenterly. In the light of the benefits protection in these transaction, the study on the European Union countervailing procedures is valuable in both practice and theory. The authority of the Countervailing Law exists in its transparent procedures, objective fact-confirmation and adequate remedy. In order to find countermeasures against the European Union countervailing, the paper tries to expound the complex countervailing procedures by studying cases and analyzes European Union countervailing procedures.Firstly, this article explored the distribution and corporation between European Union Committee, European Union Council and the European Union advisory committee during the process of countervailing. Among these authorities of countervailing, European Union Committee playes a key role while the others play an auxiliary role. So the organ who is in charge of countervailing affairs in European Union is not a complete single-line mechanism. Secondly, this article forcused to discuss the investigation procedures in European Union countervailing procedures in which large number of cases are used to profoundly illustrate the manners of countervailing investigation in European Union. European Union Committee who is bound to check the appealing and start procedures strictly and bear the obligation to keep case confidential applies various and flexible investigating ways. A large room is left to European Union Committee to use discretion in the investigation. Finally, the final aim of this article is how to improve Chinese legislation of countervailing and how to face the countervailing investigation of European Union. By detaily analyzing the current situation of Chinese legislation and the situation in which Chinese enterprises face anti-subsidy actions, this paper provides some suggestions of legislation and tactis of enterprises facing anti-subsidy actions, and tries to provide some references to the legislation and practice of our country.
