Research On Fair Use System In The Network Environment

The copyright law keeps the dynamic balance of benefit by the fair use system.The fast development of network and digital technology has post a great threaten tothe traditional copyright law system and puts forward a new problem of balancebetween the interests of copyright holders and the public. It is a hot topic whether thetraditional copyright system should be remained or regulated under Internet. Thethesis first analyzes the concept, character and the standard on the fair use in thenetwork environment. Then, the new problems of the fair use in the networkenvironment are discussed in the paper.In the first part, the concept, the legal essence of fair use and the scope of thefair use in the network environment are introduced. The impacts of standards on thefair use are also analyzed.The new problems of fair use in the network environment are discussed in thesecond part, for example, temporary reproduction, digital library and long-distanceeducation.In the last part, the deficiency of fair use system of China is analyzed, and somelegislative suggestions on the establishment of the fair use system are put forward.
