Explore The Fair Use System Of Copyright In The Network Environment

Fair use system is also called free-usage system, which means that under certainconditions people can use other’s copyright freely without the consent of the owner and donot have to pay for it. The core value of intellectual property law is to facilitating thecommunication and development of Literature-art and science-technology. Similarly, as a partof intellectual property law, the copyright system whose core values are to encourage thecreation and dissemination of Literary and Artistic works. Currently, theCommunication-Network is under the condition of constantly updated and rapid development,and in such network environment some unprecedented challenges has been brought to thetraditional copyright legal system.One of the purposes of the copyright legal system is the benefit balance between thecreators, users and disseminators, and according to this balance the development of culture,arts and sciences has been realized.In this paper, we have analyzed the history and currently status of fair use system throughinvestigating the copyright legal system’s development process. Then we found that thiscopyright legal system has appeared some drawbacks in the context of networkcommunication environment. In addition, combing with these drawbacks we have analyzedthe existence and further development value of this system and present a novel idea abouthow to improve the copyright legal system based on some foreign experience. This article isdivided into four parts.In the first chapter, we have analyzed development situation of the copyright legalsystem and introduced the generated and legislative motivation of this system. In the secondchapter, we have sated the copyright legal system under the network environment, and in suchenvironment the traditional copyright legal system will face to what kinds of new problemsand influences because of the rapid development of network communication technology. Inthe third chapter we have introduced development situation of the copyright legal systemunder the network environment through the international treaties and foreign legislation. Inthe last chapter we aim at our existed copyright legal system and analysis it’s improvedirection and proposed some valuable suggestions.
