Study On The Legal System Of The Individual Credit Reporting

The market economy is a credit economy which demands to construct perfect social credit system .Nowadays, our country's credit collection is at the beginning stage and the phenomenon of lacking social credit is serious. All these have an effect on economy and social sustained developing strategy. It is imperious demand for public figures to construct service of credit collection. About how to construct social credit system, economists, sociologists, jurists have their own thoughts. Meanwhile, it is urgent that individual credit should be improved by the legal system of constructing credit collection.The purpose of this paper is to research on the legal system of individual credit collection. The paper refers to advanced rules and concept system of other countries'the legal system of credit collection .Under the current situation, it focuses on individual credit collection from several parts such as, legislative principles on individual credit collection, credit collection patterns in legislation, legal status of credit collection organizations, basic law and specialized law in individual credit collection legislation.The paper includes four parts. The first chapter introduces the concept and theories on individual credit collection construction. Such as the definition, types, the function of credit and credit collection, the theory foundation, the necessity and intention to construct individual credit collection. The second one introduces the relevant experience of other countries'individual credit collection construction. It focuses on the selection, legislative situation and protection of privacy right in other countries. Then, it points out the meaning to use other countries'experience in this field. The third one gives an account of the current situation of individual credit collection construction in our country. It analyses concretely the problems on construction of individual credit collection. The last part discusses on the intention to perfect the legal system of individual credit collection. Firstly, it introduces models of individual credit collection organization. Furthermore, researches on the construction of the legal system of individual credit collection from two aspects, basic law and specialized law on individual credit collection legislation in our country.
