A Research On Legal System Of Wildlife Protection In China

Wild animals are the cornerstone of natural ecological balance and indispensable partners of human survival development , it is of great significance to protect wild animals ,in order to promote human development in harmony with nature."The People's Republic of China's Law on the Protection of Wild Animals"has been putting into effect for nearly 20 years of history. Through all levels of government, civil society and animal-loving people in the extensive publicity and in-depth implementation for 20 years, They raise awareness of the general public's wildlife protection , they also raise the whole society to enhance the sense of the legal system, All played a crucial role on the protection of wild animals. After the reform and opening up, China's rapid economic development, China's society, economy, Culture has undergone tremendous changes.However, China's Wildlife Protection Law has not get along with social progress and development, The overall level of legislation remains in the initial stage, there are still many problems and shortcomings in the legal system which no longer meet current protection of wild animals is an urgent need. Therefore, in order to maintain the ecological balance and protect wild animals better, we need study on the existing wildlife protection law to improve legal system of China's wildlife's protection .Firstly, this paper study on wildlife's definition and scope , as well as defined wildlife protection connotation and further detailed the significance of development between man and nature for the protection of wildlife harmoniously and maintaining the ecological balance.Secondly, this paper analyzed the status quo of the wildlife's protection, pointed out the achievement and problems of wildlife protection that exists.Again, this paper analyzed and discussed the problems and reasons which China's existing legal system of wildlife protection exists, pointed out that the basis of the theory which is current legal system of Wildlife is unscientific and that the current legal system in China as a wild animal in the legislative purpose of this lag exists, there are many gaps in legislation, Wildlife Protection Act to the basic system, local legislation and criminal legislation is not perfect; On the enforcement side, wildlife enforcement bodies are scattered , the personnel of law enforcement don't enforce laws strictly and the quality of law enforcement personnel are not perfect; Beside, people's awareness of wild animals'protection is not strong, and consumer attitudes is backward and people damage wildlife habitat seriously.Finally, in light of the many problems that our country's current legal system of wildlife's protection , the most urgent problems is not a simple introduction of a a law or amend certain laws, but to solve wild animal protection legislation theoretical base. This paper critique human egocentrism ethics and human egocentrism ethics, the protection of wild animals should take ethical concept of sustainable development as the theoretical basis for legislation. I put forward some proposals and solutions for perfection of legal system of wildlife's protection.I expect to provide useful lessons and proposals for the protection of wildlife, in order to improve the level of the legal system .
