At the same time, it makescapital of real estate developers run fast and smoothly, and lowers their management risk. It isalso one of safest loans for banks and provides banks stable profit. Due to vacancy of relativelaws and regulations and their poor enforcement in our country, the judicial practice is in chaos.Starting from the conceptions of commercial housing and mortgage, seeking the background oftheir origin and history and combining the practice of our country, this paper analyzes thedifferent features and characters between mortgage in advance sale of commercial housing andother conceptions and expounds the risks and their reasons in practice.
