The tobacco industry in China maintains monopoly of sale system where thegovernment holds whole management of the craft for a long time. But now, themonopoly system appears lots of problem after it has been working for over 20years.Besides, the law system of tobacco monopoly cannot meet the needs of thedevelopment of tobacco industry especially after we be one of the members of WTO.The referring law systems should be changed in this situation. Reconstruct the tobaccomonopoly law system is the necessary and essential step during the reform of Chinatobacco industry.Combining the management and practice of tobacco industry, this article ponderson the law system of tobacco monopoly, with studying the experience of foreigncountry. The current laws of tobacco monopoly in China should be improved; newessential legal principles in tobacco law system should be built and new legal rulesshould be laid down.
