Research On Legal Issues Of Aviation Insurance In China

Aviation insurance originated from the beginning of the 20th century. In China, People's Insurance Company of China provided the first aviation insurance policy for CAAC in 1974, which marked the beginning of the civil aviation insurance in our country. With the rapid development of the civil air transportation in the past 30 years, aviation insurance has been playing more and more important role in our daily life. However, people in China are now very deficient in the knowledge of aviation insurance and the study on law of aviation insurance is still at the starting stage. So, it is of great value to probe into the legal relation of aviation insurance so as to set up the legal system of aviation insurance in our country.This thesis is an attempt to aviation insurance research on related legal issues, including the preface, four chapters and the conclusion. The preface mainly expounds the background of the research on legal systems in aviation insurance, detailedly introduces the progress made in aviation insurance at home and abroad and explicitly describes the content of the thesis. By employing comparative and comprehensive methods together with the method of combining theory with practice, the thesis makes theoretical analysis on the concept of aviation insurance to come to the conclusion that aviation insurance is a comprehensive insurance, defines the content and specific areas of responsibility of various types of aviation insurance by classification, puts forward the feasibility of developing flight delays by law according to the increasingly serious problem of flight delays, discusses the application of the basic principles of insurance law in the aviation insurance by combining insurance knowledge, and finally develops the preliminary idea of constructing the legal system of aviation insurance contracts by borrowing some of the regulations of maritime law. On the basis of the discussion above, a basic framework of the legal system of China's aviation and insurance is laid out with the hope of providing some reference to establishing and improving the legal system of China's aviation insurance.
