A Study On The Relevant Issues Of Insurable Interest In Marine Insurance

Following the mainline of the principle of insurable interest in marine insurance contract and other concerned aspects relying on the Insurance Law of PRC and the Maritime Code of PRC, connecting relevant foreign legislation, especially the British Marine Insurance Act 1906,and theories concerning marine insurable interest, combining domestic and foreign insurance practices and judicial actions, the paper makes a study and analysis on the issues in relation to the ascertainment and application of insurable interest in the marine insurance in China, discusses to whom the interest should attach and when the interest must attach, and disserts the insurable interest in three aspects of cargo interests, hull interests and interests of marine reinsurance. On these bases, the paper raises constructive suggestions on the amending to the chapter of marine insurance contract in the Maritime Code of PRC and on the problems to which should be paid attention during the insurance practices in China.
