The Patent Protection Of Gene Technology

Nowadays, each country competes for its comprehensive national power, which, in fact, is the competition for modern science and technology. The most representative of modern science and technology is gene technology. With the world trend of necessary property right of protection for gene technology, our China should have more consciousness of the gene technology patent. Only in this way can we survive in the fierce competition of the world market and promote the development of our national technology and industry.The thesis includes six chapters. The first chapter gives a brief introduction of some related important terminologies and their background. The second chapter studies the basic questions on the gene technology patent. The patent conferment of gene technology is introduced mainly in developed countries like America, Japan and Europe. Based on this, the third, fourth and fifth chapters mainly discuss the theme of nowadays patent issues such as gene sequence, transgenic plant, and gene diagnosis and its treatment. The last chapter combines the development of gene technology industry, the status quo of gene technology patent in our country and then advances some suggestions for improving our country's patent law of gene technology.
