The complainant's qualification in administrative litigation is an arguable issue in theory and judicial practice. It is difficult to identify and uniform the standard of complainant's qualification. This paper comprises four parts to discuss the complainant's qualification.Part I introduces the basic theory about complainant's qualification in administrative litigation. This portion especially analyzes the definition and value of the complainant's qualification, and also examines the relationship between the complainant's qualification and other related concepts.Part II focuses on the complainant's qualification in USA, UK, Germany, and Taiwan area. The author intends to find out the similarities among the countries in those aspects so as to draw some guidelines through comparative and inductive methods. The portion tries to provide help for legislation and understanding of complainant's qualification in China.Part III of the paper reviews the history of complainant's qualification in China and discusses how to determine the qualification in practice. The author finds out the defects of complainant's qualification in legislation in China to improve the system.Part IV sets forth the details on how to give the new content in "interests in law", extend sphere of complainant's qualification and establish the legal precedent and administrative public interests legislation, in order to improve complainant's qualification in administrative litigation.
