A Research Of The Evaluation Before Local Legislation

The evaluation before legislation is regulated as a procedure of legislation in the Legislation Law of the People’s Republic of China(2015 amendment),that leads the development of the evaluation before legislation.Many provinces have implemented the evaluation before legislation during legislation and some have made regulations.At present,the study and the practice of the evaluation before legislation are still at the primary stage in China.Researchers do not make an agreement on the evaluation before legislation,and practice is different.A systematical and institutional procedure of the evaluation before legislation is not formed.This paper at first explains the definition of evaluation before legislation,and then analyses the practice of the evaluation before local legislation,and points out the defects of the subjects,the objects,the process and the use of evaluation conclusions of the evaluation before legislation.At last,this paper gives some advices of improvement according to the defects discussed above.
