Study On The Legal Status And Responsibility Of The Forwarding Agent Of International Air Cargo

Along with the development of international air forwarding industries, relevant legal issues, especially the legal status of international air cargo forwarding agency enterprises, become complicated more and more. Does an international forwarding agency enterprise act as an agent or a carrier, or act as the agent of the parties? What are its relevant liabilities in respect of each circumstance?This article starts with the introduction of relevant theories, analyzes the conclusion that an international cargo forwarding agency enterprise can either act as the agent of a shipper or carrier or act as an independent business operator. Under the second part of this article, the author generalizes the general agency theory and analyzes the legal status of international air cargo forwarding agency enterprises. Based on relevant international and domestic systems, the author, after the summary and introduction of relevant international conventions and legal documents and laws, regulations and rules of our nation in respect of international air cargo forwarding enterprises, centralizes and studies the liability system of the international air forwarding under relevant international legal documents and further sets forth the content of the liability system of our nation in respect of international air cargo forwarding agency enterprise under the third part of this article. Then, in order to settle the issue on the identity and legal status of international air cargo forwarding agency enterprises, the author further summarizes and analyzes several circumstances of the business operation of international air cargo forwarding agency enterprises and the standard to identify the legal status of an international air cargo forwarding agency enterprise under the fourth part of this article.
