| The judicial proceeding is an inevitable course get through by a judge who hear a civil action under common procedure. As a core of trial, the proceeding is the most fundamental and important phrase of procedure. In the recent twenty years, the procedure has been reforming unceasingly. With the introduction and transplant of the westen legal framework, some problems has brought about in cohere with the national system. This thesis tries to provide reference to judicial proceeding in a civil action.This thesis has three parts. The first part is a summary on civil proceeding and fundamental evaluation on the procedural system provided by Civil Procedure Act Of CPRC, in addition, introduction of some preparation about reforms of procedural system by the angle of judicial practice and academic research. The second part is a comparision of judicial proceeding in USA, UK, Germany, Japan. The third part is an assumption on improving and perfecting the contemporary procedural system of civil trial; suggestion on establishment of a centralized trial system; the roles of judges and parties in action are to be rationally divided ; adjustment of composition of a judicial trial and optimization of the system about proof ,examination and ascertainment of evidence. |
