Some Problem Studies Towards The Chinese Government Subsidy

The papers bases on the analysis in the concept, characteristic and classify to the government subsidy, firstly begins to discuss the behavior character of government subsidy and its law applying to, viewing that, it often shows out as the public behavior and the administrative private behavior in its different stages. Accordingly, the public behavior applies to the public law and the administrative private behavior applies to the public law and the private law. And then, It is found that the government subsidy must be controlled by a new law containing the authority of setting up a subsidy, the scope of subsidy and the restrictions of procedure for it, thought the lacking of restrictions from the budget law and the tax law. At last, the author talks about the legal suit for the subsidy relative people and the interested third party, and they are authored to apply to the administrative reconsideration and the legal action for their benefits.
