A Research On The Legal Problems Of Anti-absorption Of The EU

Anti-absorption is an important concept and unique part in EU's anti-dumping law . It has been playing an enormous role in ensuring the performance of EU's anti-dumping measures. At present, otherwise, such a regulation hasn't been stipulated in WTO law and China's native law. This article makes an overall analysis on some basic theoretical problems it touches upon so as to better understand the regulation of anti-absorption to guide the judicial practice.Three main research methods have been applied. Firstly, the method of practice-analyzing. It analyzes all the related anti-absorption cases aimed at China combined with the clauses of the EU's anti-absorption law . Secondly, the method of systematic research has been applied to expand the macroscopic horizon of anti-absorption theory and upgrade the theoretical basic point of anti-absorption research .Thirdly, the method of comparison. This article compares anti-absorption with other legal branches and problems so as to reveal deeply into its essence..In both theory and practice, this article seeks to expound a series of legal problems of anti-absorption so that its basic theoretical frame would be taken shape: the legality and rationality of anti-absorption, the relationship with other legal branches , distinctions with anti-circumvention and interim review and its nature. On this basis, combining the legal stipulation with judicial practice of the EU's anti-absorption, it analyzes the causes why the Chinese products have been suffering so many anti-absorption investigations and puts forward China's countermeasures as well as the legislation blueprint.
