One of the hottest topics in recent years is regulation on the existing property account. With ascending of the existing property market as land resources are finite, the potential safety hazard is more and more serious. Cases of Tianjin huizhong brokerage firm and anhui taoyuan brokerage firm are suitable examples. The author chooses this topic as graduation thesis also because of recent condition, and hopes to make a breakthrough in resolving the problem.The cause of potential safety hazard is the existing property account going through brokerage firm, this makes a chance for brokerage firm to misappropriate the capital. At the same time, laws on regulation of behavior of brokerage are not available, especially laws on the safety problem of existing property account. Few scholars have studied the regulation of the existing property account completely and deeply both in theory and in practice so far in the searches scope of the author. Some local governments have banned relevant precautionary measures or relief measures, but all of these just treat symptoms but not the disease. The author is trying to make up the problem of potential safety hazard and contribute to the improvement and development of the existing property market. The value of this essay is the deeply study of the source of capital potential safety hazard and bring up some effective measures. These measures may be involved in recent research, but have not been banned as laws and are lacking a round system. The structure of this essay is as follows:Chapter one: About the recent condition of regulation of the existing property account and analysis of relevant laws. The author introduces problems in recent time and makes an example of Tianjin huizhong brokerage firm to analyze the source of problem at full length. After that, the author minutely interprets relevant laws.Chapter two: Theory analysis of the regulation of the existing property account. In this part the author focuses on the theory basis of the regulation and researches on the necessaries.Chapter three: Construction of the regulation of the existing property account. According to the analysis of the standard of choosing regulator and all kinds of regulation styles, the most suitable style may be regulation by bank and guarantee corporation together. At the same time, relevant precautionary measures are indispensable, including: exemplary version of contract, system of notification, system of security of business and system of challenge and dispute treatment. If the article could benefit to the reform of our regulation of the existing property account, it would be the author's most pleasure.
