Consummate The Procedure Of Informing Before Judgement

Deyang arbitration committee tried out a new procedure named Inform Before Judgement(IBJ) in 2004. This innovation has aroused of enormous interest of the national arbitration public. And it has become recently arbitration development hot topic and also has caused the theorists and the practical realm to dispute it.In order to comprehensive accurately understand IBJ, at first this article introduces the background of IBJ and the different responses to the IBJ from different scholars; In the second chapter the author analyses the arbitration principle of IBJ and make sure its realization, possibility and feasibility;In the third chapter the author proposes to establish related systems such as the discharge of duties of the arbitrator, arbitration evidence provision, the expansion of arbitration mediation, the expansion of the content of IBJ, and the realization of the balance of fair and benefit; Finally in the fourth chapter the author set up some systems to deal with the possible inequity: consummate and perfect arbitrator system, establish case check system, avoid to the exceeding judgment and the negligent judgment and set up the judicial relief measure .
