Although 68 charges on capital punishment have been provided in our criminal law currently in effect, in judicial practice less than 1/3 of them have been practically used, and less than 1/5 of them have been frequently used. On the one hand, most of the charges on capital punishment are left unused; on the other, the total number of these charges is among the most of all countries in the world. Is the design of charges on capital punishment in our criminal law reasonable? Pondering over this issue, the author classifies the provided charges and makes value evaluation. At the same time, the author also analyses cases related to frequently used charges in practice to prove that the design of charges on capital punishment is not so reasonable through scientific analysis. Comparative analysis is also applied to introduce related designs in Japan, Russia, Germany and other countries, in order to absorb the quintessence of those criminal laws. The author also puts forwards tentative plans on the reformation of capital punishment in our criminal law, and tries to find a practicable way to consummate the design of charges on capital punishment in our criminal law.
