Researching On Social Collection

Social collection is a new business in modern society . At present, there is no statute law in the world concerning on it . In our country, only Charitable Donating Law looks into the problem of charitable donating. In this law , collector could only be body for charitable benefit and entity for common goods . Other body and entity do not adjusted by law. Neither does online collection.At present, there is a lot of s troubles in social collection partly because of so many methods on collection, such as charitable donating, Private donating , directional donating , unidirectional donating , online collection and so on . People of theory and practice argue on the nature of social collection ,attribution of the surplus money and administration of the money .But no body takes professional researching on it . The thesis looks into the related problem of public collection by the way of analogy and comparison method . Above all, the author suggests that public collection referable to Private trust and implied trust. Taking resulting trust in English Trust Law into account, the problem of attribution of the surplus money could be resolved .Concerning on the principle of charitable trust, the problem of the surplus money could be settled . It benefits to practice .
