Since the trust law in 2001,the development of public trust are few.After 2008 the state encourages trust companies to support the development of public welfare in the form of public trust,the trust companies in order to adapt to the demand of the market,launched the "trust plans of assembled funds with characteristics of donation",this article studies of quasi public trust,it is a new type of trust model,is to give priority to public welfare purposes,contains both interests,the purpose of the trust.Quasi-public letter appears on the trust legal system and the trust has great significance to the development of the market,not only improve the trust market environment in our country,explore the space for development of China's public welfare undertakings can also improve the trust law system in China.With the continuous development of economy,social public enthusiasm is growing,the development of public trust more and more,but at present our country for study of quasi public trust is not deep and legislation is blank,the lack of corresponding legal system to support,make the social public to what is quasi public trust,in the form of how,and how to set up a public trust,and under the existing trust system,set up a quasi public trust of special provisions don't know if you need.In order to continue to develop public trust,need from the legal system to establish the status of public trust.This paper studies the establishment of quasi public trust system,defined the quasi public trust between public trust and interests,trust,but mainly public independent trust again,and quasi public trust of the particularity of the purposes of the trust,the experience from abroad to set up the system,for the establishment of quasi public trust in China are put forward.This article will discuss the problem in five chapters:The first chapter is fthe introduction,mainly introduces the background and the significance of this article,and comprehensively summaries the documents we have right now,expounds what we research and how we research in this article,shows themain work and innovations in this article,introduces the basic structure of this article in the last.The second chapter defines quasi-public welfare trust and all the concept about it.This is the basic of researching the system of quasi-public welfare trust.Through the discussion in the academia and the performance in the practice,we can define the meaning and characteristics of quasi-public welfare trust at first,discuss the legal attribute of it,define the quasi-public welfare trust as a public welfare trust secondly.Distinguish quasi-public welfare trust,public welfare trust and private trust and relater concepts at the end of the second chapter.The third chapter is the development present situation and existing problems of public trust,first of all,this paper introduces the development status quo of quasi public trust,including the development of the model,the effect of the development and the development of the obstacles,secondly in case as the breakthrough point,analysis must set up the problems existing in the public trust.Chapter four is the reference to the foreign system of charitable trust.Mainly introduced from the aspects of procedure and entity,the procedure is to set up the system in foreign countries,analysis function and effect of registration;Program mainly introduces the exception to the rule of the charitable trust and U.S.interests separation trust model,put forward the inspiration and reference to our country.Chapter five is the suggestion for the establishment of registration system for quasi-public trust.Including set up the way of public trust,quasi public trust trustee new exploration in the form of organization and the supervision system of public trust.
