Study On Protection Of Consumer's Right To Know

The consumer—protected problem has obtained the full attention in the worldwide scale. And fundamental right of consumer rights system is the consumer's right to know. Therefore it has become a legal right in many countries. However, pausing on ideal level in China, the consumer'rights is violated in the realistic society very often.At present, our country still doesn't arrive to the protection of consumer's rights and interests, not yet establishes the scientific and comprehensive protection system. That affects consumer's legitimate rights and interests seriously. And this thesis, through advanced experiences abroad and academic circle's beneficial viewpoints, attempts to give some effective suggestions to protections of consumer's rights and interests.The thesis consists of four parts.The first part is about the introduction to the consumer's right to know. It starts with analyzing background of the rights, and discusses the source, concept, feature and protective significance of it. Hence this part lays the foundation for next issue.The second part specially studies the basis of legal principle. Based on a comprehensive analysis, the author points out three bases: Asymmetry of information theory, Honest reputation theory and Basic human rights theory.The third part elaborates the consumer's right to know and proprietor's duty to disclosure. To protect the rights effectively, corresponding direct obligor's active behavior must be emphasized. If there isn't this duty, the consumer's right to know will lack the existing basis.The last part discusses the current situation regarding protection and improvement of consumer's right to know in our country, as well as its existing deficiency .On this basis, the author puts forward to some feasible countermeasures, in order to the transforma from written rights into actual rights. The establishment of legal system to protect consumer's right to know is a huge systematic project. Perhaps the author's superficial view doesn't have much effect and just does his duty as a law―learner. The aim is to trigger more discussions of wise men and facilitate promotion of a correlative system finally.
