The duty of tolerance for the individuals to the country in the criminal procedure, especially in the detection procedure,have the important significances in both theory and practice . It is of great value to expound the scope between human rights and state power,to avoid the mutual conflicts, to evaluate the extant detection procedure and to choose and construct the new concrete detection procedure system .This article starts from the foundation of legal principle of the duty of tolerance, to make an overall analysis of its meaning, conditions, essences, influence factors, and the relief ways, to combine with the detection procedure,the extant problems in the detection procedure have been evaluated and rethought, making use of the duty of tolerance as the analyzing tool.
