Abstract/Summary:
After its entry into WTO, China has quickened its steps on regional economic cooperation and launched FTA negotiations with many countries and regions. Rules of origin(ROO) is one of the key items in FTA negotiations. This paper starts with ROO for goods and their effects on international trade, discusses the practices of ROO for goods under FTA, compares ROO under FTA with those under GSP, WTO HRO and China non-pereferential ROO. In combination with the practice of origin administration, the paper points out the deficiencies in China's current ROO under FTA: The current FTA negotioations are largely subject to the country's political and diplomatic needs, lacking in both fundamental study on FTA rules of origin and wide participation of the industries and chambers of commerce. The FTA rules of origin in practice have various limitations and the translation of FTA rules of origin is to be improved. The SPAGHETTI BOWL phenomenon has not been paid much attention to. It is suggested that for better maintaining national economic benefits, there should be overall consideration of FTA ROO from planning, negotiation, to promulgation and application, based on domestic situations and benefited from foreign experiences on FTA negotiations and implementation, bringing the initatives of government authorities, enterprises and academies into full play, so as to put the outcome of FTA negotiations into real effect.The application of China's ROO in Jiangsu is analysed, reaching the conclusion that there is further space for better implementation of FTA rules of origin in Jiangsu. Suggestions for better implementation of FTA rules of origin are also provided.
