On Administrative Contract System

As an important way for government to carry out administrative management, the administrative contract has already proved its value in modern country, especially in western countries. In China, administrative contract first appeared at the very beginning of reform and opening up to the outside world, accompanied with the continuously development of the market economy in recent 20 years, the administrative contract has been more and more widely used. However, among all the laws and regulations, there's no 'administrative contract' and this phenomenon is considered as a shackle for the development of administrative contract system. This paper starts from the basic theories of administrative contract, by analyzing the administrative contract system in western countries, makes a summary of the current situation in China. Then, it points out the defects of the system in our country. Finally, this paper offers some measures to consummate our country's administrative contract system. The author hopes to discourse upon the four mentioned areas above, aims to solving the theoretical problems of administrative contract in our country to some extent and effectively promotes the administrative contract to play a more important role in our country's modernization construction as well.
