On The Subject Of China's Civil Aviation Supervisory Agency And Administrative Responsibility

With the rapid growth of the economy in China, the demand for air transportation is ever increasing. Along with the accelerating development of China's civil aviation industry, issues in aspects of the civil aviation system and its supervision are constantly exposed and are gradually becoming constraints in the development of the industry. Therefore, theoretically and practically, how to strengthen and improve the supervision of civil aviation market comes out to be a serious subject.Based on citing issues in both modes and supervision system of the industry, this paper pointed that positioning reasonable regulatory bodies and administrative responsibility is the key to speeding up construction and improving the supervision system of the industry. In the supervision of the civil aviation industry, in which the main civil aviation supervision body is jointed by the Civil Aviation Administration of China and the Civil Aviation Association, the supervision centers must undertake corresponding administrative responsibilities according to their positions. According to the administrative responsibility theory, this paper mainly analyzed the responsibility of the main body in their creation of criterions, administrative permission and administrative law enforcement and made suggestions on how to improve the supervisory system. This paper is composed of five chapters, structured as follows:Chapter I introduced the current status of China's civil aviation and its supervision system. It included the development of the air shipping industry and the status of civil aviation supervision system, and pointed out problems which were due to backward civil aviation supervision system in the rapid development of the civil aviation industry. Chapter II introduced the evolution of Civil Aviation supervision mode and its trends. This chapter details analyzed the two modes in the traditional market supervision system and the development trend of the system and introduced two typical foreign supervision modes. Finally combined with China's national conditions, regulatory approach to the development trend of foreign civil aviation introduced a typical two existing regulatory, and combining with China's national conditions made a preliminary choice for the system.Chapter III analyzed the main civil aviation body and its administrative and supervisory responsibilities. This chapter introduced the main administrative supervision body and main self-supervision body and analysis their administrative responsibilities.Chapter IV is the analization of the executive responsibilities of the main Civil Aviation administration body. This chapter used cases to analysis the responsibility of the main body in their creation of criterions, administrative permission and administrative law enforcement and explained clearly of what kind of responsibility each one should take.Chapter V gave out the detailed administrative responsibilities and suggestions for improving China's civil aviation supervision system from aspects of improving the legal system, establishing a compensation mechanism and a supervision mechanism and strengthening the training of the supervision officers by researching the issues exposed in the Civil Aviation supervision system in the rapid development of civil aviation over recent years.New points in this paper as follows:The first one is the innovation in the main idea. This paper discussed and analyzed the administrative responsibility for the main body of China's civil aviation systematically and presented a well regulated legal suggestion.The second is a new entry point. In this paper, starting with the main administrative body and its responsibility, by using the method of analyzing and defining gave out a theory for the supervision mode and method of improvement.
