The Mechanism On Anti-terrorist Crime Of Administrative Law Enforce And Criminal Justice In The Field Of Civil Aviation

International aviation terrorist activities is frequent and poses a serious threat to the security of civil aviation.Faced with the increasingly severe situation of aviation terrorism crime in China,anti-terrorism has become the priority in maintaining the security of civil aviation.Legal regulation is an important means to prevent and combat aviation terrorism crime which involve administrative law enforcement and criminal justice.How to establish and improve the connecting mechanism between the two has become a key problem to promote the legal construction of aviation anti-terrorism and the cooperation between the civil aviation anti-terrorism departments.China's connecting mechanism on civil aviation anti-terrorism of administrative law enforce and criminal justice is still in its infancy.There are still many problems in the two aspects of law and practice.In terms of law,the definition of terrorism in various departmental laws has not yet been unified.Although there are provisions on the transformation of administrative law enforcement to criminal justice,the criteria for the transformation are not clear enough.In practice,the sharing of anti-terrorism information in civil aviation is still insufficient,and the communication mechanism between civil aviation administrative departments and airport public security organs is not perfect.To a certain extent,these problems affect the effectiveness of civil aviation anti-terrorism law,and also leave hidden dangers for civil aviation to prevent terrorist threats.Consequently,it is necessary to improve the connection of civil aviation anti-terrorism laws and regulations,define the criteria for transferring cases,improve civil aviation anti-terrorism information sharing platform,and innovate communication and cooperation mechanism between departments.Then it is beneficial for efficiently preventing and combating aviation terrorism crime that when the connecting mechanism of administrative law enforce and criminal justice play the superior role,and provide legal protection for civil aviation administrative departments and airport public security organs to jointly construct a defence against civil aviation terrorism crime.
