Supervision On The Judicatory By People's Congress: From Individual Case Supervision To Similar Case Supervision

An important authority and job of People's Congress is supervision on the judicatory. Local People's Congress groped for measures of individual case supervision on the judicatory in the past years. But society all circles dispute it and the appraisement is not identical. Supervisory law which prescribe superintendence of all levels People's Congress emphasizes to strengthen the supervision on the judicatory. The law insist that we muse settle the problems which the common people have strong reflection and they have commonness in the justice job. The article considers on the individual case supervision, and suggests it is a special method which People's Congress exercise authority in peculiar condition. Although it haves inevitability of history in particular period, it should not be emphasized excessively. The article interprets the text and nomology of supervisory law, analyses function position of superintendence on the Judicatory by People's Congress. The article comes to a conclusion that People's Congress must find an optimal bonding point when we strengthen the supervision by People's Congress and ensure judicial independence. We try to construct a series of systems about the Similar Case Supervision which are scientific and reasonable, and urge Supervision on the Judicatory by People's Congress to be a macroscopical and institutional construction force. The aim is to maintenance universal equity and justice of society.
