With the development of science and technology, the scope that human being reconstruct the nature is more and more extensive. As the result of the reconstruction, the pollution has brought a series of problems to the countries such as: the acid rain, the destroys of ozone layer, the green-house effect on the global climate, the sharp decline in biodiversity, the virulent chemical pollution and its transfer crossing the border, intensive soil degeneration, exhaustion and pollution of fresh water resources. So protecting the environment becomes a issue that most coutries must solve urgently and a forcus international society has to attend. Human being realize strongly that destroying the environment willfully causes the severe retaliation from the nature. Human being have to reconsider the relation between humans and nature and start to attach much importance to the nature. They hope to make friend and assort hormonally with the nature, and to establish the concept of protecting environment and realizing the sustainable development.In order to protect the environment and realize the sustainable development, many countries and sholars have did large numbers of research and exploration to how to sovle the environmental tort problems lawfully, which the discussion of environmental tort is from.This article discusses what is environmental tort, how to congnize the environmental tort and how to carry out the relief after the environmental tort has happened.
