The fixed assets of the real estate industry shares more than 50% of the total fixed assets of a certain period. The investment in residenceconstruction accounts for 3-8% of its GDP, and 20-30% of its total fixed assets.Compared with the developed countries, our real estate industry is far from maturity. Therefore, there is an urgent need to attach more attention in the development of the Real estate industry.Bank is the major agency in financing for the real estate industry. It is beneficial for the development of the real estate's financing business by loading money to housing consumers as well as to the land agent, guaranteeing a benign cycle of credit funds and dispersing the risk. If bank provides loans toward land agent only,the loan funds can't get into virtuous cycle, increasing the risks. According to the law of value, the merchandise building is merchandise, which is a process of both the formation and realization of value. After Merchandise building being produced, if they can't be sold, this kind of product then becomes huge sum of tying-down of capital. The funds can't take back as soon as possible; the cost of interest will increase greatly. The fund that can't take back in time becomes bad debit. So the funds can only be taken back smoothly by making the merchandise building being sold out as soon as possible.Currently, a number of cities have started housing mortgage load business, and some have reached great success. Along with the extension of the business, the Phrase "mortgage" appears more and more frequently on the top of the newspaper, magazine, news and the topic among people. However, mortgage is still in the introduction stage in our country without enough experience, and the mortgage system isn't sound either. Moreover, the law is not complete, which brings inconvenience to practical operation of mortgage and causes disputes easily. But if the housing mortgage works smoothly, it will prompt the development of real estate industry and boost the development of other relative industries. Therefore, there is a call for the research and study in housing mortgage loan.The main purpose of this thesis is to have a more specific analysis on the risks each participant may face in the housing mortgage and the relevant measures against each risk. This article firstly have a good understanding of the concept of mortgage, and then compare the mortgage system in our country and developed countries, like UK and US. It also shows the current situation of mortgage system in the mainland. According to the participants and its role in the mortgage, the article analyze those risks participants may face from a perspective view of the law, and the measures each participate should take. |
