Argument And Proposals For Body Right

With the growing development of the modern economy, the social structure is becoming more complex, people are beginning to realize that the value of the human body. They hope their value, dignity and security could be protected by law . The body of a citizen is an organic human being body composed by various organs. It is the physical carrier of life and health and also the physical carrier which enables a citizen to be involved in social relationship and to have rights and take responsibilities. As an independent human being right, Body right gives a person the right to safeguard his/her body.However, China's current legislation on Body right is rarely, and lack of operable in judicial practice. So, this paper studies on Body right, starting with the concept of body right and the legal characteristics, making the nature of the physical clearly, discriminating between body right and other related rights as the right to life, the right to health. Meanwhile, analysis the elements of violations of the body right and the main mode in detail. The last, using comparative analysis of the domestic and international legislation of a detailed comparative study, written analyze the institutional shortage in protection in Body right in our current law system, inducing the relief that the current civil law of our country can give to the victimized person whose body right was suffered, and give a in situational speculation to how to perfect the protecting system of Body right.
