Study On Anti-dumping Dispute Settlement Mechanism

Dumping is an important tool of competition, which is rational according to the explanation of economy. Along with the development of international trade, a number of countries take anti-dumping measures frequently. In name, they are exercising their right of anti-dumping, but in fact they are protecting home industries that slow down the development of international trade to some extent. Recently, dumping and anti-dumping are used more widely and frequently and the conflicts between dumping and anti-dumping become more and more severely. Those have drawn attention of many countries. World Trade organization (WTO) supplies a place for the member to settle disputes.《Agreement on Implementation of Article VI of the General Agreement on Tariffs and Trade 1994》,《Understanding on Rules and Procedures Governing the Settlement of Disputes》and the body concerning the disputes settlements all supply an guarantee to the dispute settlements.This article primarily uses the method of positivism analyzing and normal analyzing, guided by the theory of international law and comparative law, and though a comparative analysis of the articles and cases which have been settled by DSB, summarizes the inherent orderliness of WTO anti-dumping dispute settlement, sums up the rationale of anti-dumping law of WTO and discusses the functions of WTO dispute settlement mechanism in anti-dumping dispute settlement.The paper comprises of four parts.
