| With the development of economy and the advance of standard of living, travel is not the patent of the rich man anymore, but a indispensable part of the life of common people. Go by the name of smokeless industry, tourism is developing quickly and has become the largest industry of the world. Tourism is the support industry in some countries indeed. With the development of tourist industry, the quantities and the kinds of the dispute of the travel contract are more and more. But the legislation on the travel contract in our country is still at the stage of exploring. The domestic laws and regulations about the travel contract are seriously insufficient and few experts and scholars have discussed the relevant problems of the travel contract. It is unsuitable for the flourishing travel market. It is go against settle disputes of travel contract and normative development of travel market. In this paper, the author give a comprehensive analysis of the concept,characteristics,legal nature,the conclusion,modification,rescission of the travel contract and liability for breach of travel contract in this paper. In the end, the author proposes some suggestions on the basis of precedents of foreign legislation research and one's own practice and hope to contribute to the perfection of the legislations on travel contract in our country. Here by protect the benefits of contract parties better and accelerate the tourism developed healthily.
