The problem of climate change has become one of the most important global issues between countries. A special intergovernmental committee of climate change respectively passed the three times evaluating reports in 1990,1995,2001 These reports show that human beings activities have an obviously influence on global climate. The identity of ecosystem and the globalization of economy both make each country inevitably agrees to take the obligation of reducing the emissions of greenhouse gases, which makes it possible to use the economic way to resolve the problem.Passed in 1997 and operated in 2005, Kyoto Protocol had stipulated the goals of developed countries quota reduces, put forward four ways to realize the goals. It embodies "the differences in common principle" and also sets an example of applying environmental economics theory to international environmental protection.Kyoto Protocol brings opportunities for environmental protection of developing countries: on the one side, it creates a good situation for developing countries to attract foreign investment and advanced technology and also provides them with the advanced ,operable modes of environmental management. while on the other side. its implement simultaneously brings great pressure on developing countries ,which means they must commit themselves to the obligation of reducing gas emissions and the superposition of "locked-in effort".In "post-Kyoto", it has a special meaning for the developing countries on how to protect environment ,how to harmonize economic development with environmental protection ,how to convert developing mode, establish economic, social and legal system which adapt to environmental protection. But the developing nation this aspect correlation legislation highlights actually weakly.Especially in China ,as the biggest developing country and the second biggest gas emission country in the world, this conversion seems even more urgent. Here are some measures on how to deal with the situation: to made circulating economic law and build a economical mode society ; to perfect renewable resource legislation and make the full use of renewable resource become the possibility of adapting to market pattern.; to set up carbon sink merchandise exchange law system and perfect the legislation of woodland protection, hence to ensure the spread of biologic carbon sink technology in law mechanism and encourage domestic enterprises to take part in the interregional cooperation.
