Analysis The Perfection Of Environmental Criminal Legislation In Our Country

The environmental criminal law is one of the branches of the criminal law ,also is the object of which criminaljurisprendunce concers.Although the legislation of the environmental criminal law is unceasingly consummates at present in our country, it still have the disappointment place. This article focus on the further perfection of the environmental criminal law and on the concrete design of the system which the legislation persues.For this reason ,this article especially needs to make it clear which theory the environmental law really based on .Only so ,the perfection of the environmental law would be establelished on the foundation which are both scientific and rational.On this article is divided into four parts.The first part :the contrast of environmental law between China and the west countries. Get the same concludes of them:environmental protection intend to criminal law ,increase the protection,more andmore economisom methods will be added.The theory of environmental criminal law will be more scientific.The second part: Take anlysis into the facts of environmental criminal law to find the difficult of legislation facing in our country.There are four questions including legislation idea,legislation method , criminal construction and penlaty method.The third part: Find the reason of the above difficults from the outside and inside of the criminal law.The fourth part:Perfection of the environmental law. Make the legislation idea and basic principle clearly.Increase the criminal and penalty methods.
