Legal Analysis On Electronic Money

This thesis analyzes the legal characters of electronic money, the rights and obligations between the parties and the legal risks during the e-money circulation.E-money is characterized with credit, the same as the traditional money. It is actually one kind of money on the bases of contract.Between the e-money issuer and buyer, the legal relation is the depositor and the banker as well as the seller and the buyer. As to the e-money buyer and the accepter, they are the parties of consuming contract. Finally, the issuer shall expiate the e-money and provide the accepter with technology services.There exist many legal risks among the parties. To the issuer, it is mainly the credit risk. Besides, the tax bureau faces the increase of tax dodgers. As a new technology, the issuer shall protect the rights of privacy and information of the e-money consumers.
