The Constitutional Right Of Citizens On The Environment

Environmental issues have become a global topic that human are concerning and can't be avoid by any countries in the ages of the environment. Along with the rapid development of our social economy, the environment worsens gradually and seriously. That citizens's environmental right, as a new citizens'basic right ,should be ruled in the constitution is a inevitable trend of constitution development. This not only is the demand that enriching and developing citizens'basic rights put forwards, but also is the need for constructing and perfecting the environmental protection law system, which takes protecting citizens'environmental right as its center. Furthermore, this is also the inevitable request to carrying out the strategy of economic and social sustainable development.At first, this paper analyzes the basic theories of citizens'environmental right from two aspects: the theories define of citizens'environmental right and constitutional theory foundation. Secondly, this paper emphatically studies the constitution provisions about citizens'environmental right in some foreign countries. Meanwhile, this paper compares these provisions with those of our country's constitution on the basis of summarizing and concluding them. Then, it combs out some significant and useful experience that our country can learn from the foreign countries in order to find out the shortages of our country's constitution provisions. Finally, this paper focuses on setting up our country's system of citizens'environmental right and manages to elaborate from five aspects: the constitution guaranteeing the sustainable development, the establishment of the constitutional position of citizens'environmental, guaranteeing citizens'right to know about environment, setting up the citizens'participating mechanism of evaluating the influence on the environment as well as strengthening the law succouring towards the citizens'environmental right.The author expects to enable citizens'environmental right to become the necessary mission that the environment countries should undertake in the 21th. century by the theory research towards citizens'environmental right of our country.
