On The Attributes Of The Constitution Of The Environmental Rights Of Our Citizens

With the deterioration of environmental pollution, and enhancement of citizen's protection consciousness, the environmental right protested by citizens becomes a hot issue and a core problem discussed among the jurisprudential circle. But there is no obvious legislation in our constitution. The shortage of the constitution system is disadvantage in the full protection of the environmental rights, also make the protection of the whole law system to the citizen environment rights present a kind of low-pitched appearance. This article begins with the basic questions of environmental rights, on the basis of analyzing theoretical research results, consults the constitute experience and the implement condition of the other country, discusses the necessity of the entry of citizen's environmental right into the Constitution, and then analyses the protection present condition of my constitution, thus to establish the constitutional position as a citizen's basic right. Finally put forward constructive suggestion which suits best our background and situation.
