Antimonopoly Regulationon Abusing Of Intellectual Property Rights

Intellectual property rights mean an exclusive rights by law, while the owner abuses his rights and excludes competition to obstruct fair competition system , the antimonopoly law will rule it. Which means if the righter exercise his right beyond the principle of intellectual property system, he might be regulated by antimonopoly law. The《People's Republic of China Anti-Monopoly Law》which will enforce in August 1^st, 2008 has made principle regulation on abusing of intellectual property.This thesis stood at the circumstance of Anti-Monopoly Law, thro ugh the comparison of other countries' law, pionting that we should put abusing of intellectual property into two circumstances, one is the trading contract of intellectual property , the other is the owner uses his rights to implete monopoly.There are three parts in the thesis, the first part is the question of intellectual property abusing, the second part is comparison of other contries' law, and referernce of our regulations, the third part is the suggestion of our country' regulation. Beyond, a powerful and efficient agency is very important. Our country should make good use of Anti-Monopoly Law system, and it will be a powerful tool to prevent monopoly, encourage competition, enhance the quality of foreign investment, promote the adjustment of economic construction.
