In the21century, the competition between the countries has changed from the scienceand technology to the core of national strength. In the knowledge economic conditions,governments set up the system of intellectual property rights protection. On the one hand, thesystem of intellectual property rights protection plays a very important role in encouragingand promoting innovation. On the other hand, the multinational companies in order to obtainthe huge benefits, abuse of intellectual property rights, hurt the healthy development of themarket economy. Microsoft is one example.With China’s accession to the WTO, our government gradually improved their ownintellectual property rights protection system. Because our country government joined theTRIPs agreement, the protection of intellectual property in China adopted more stringentstandards. At the same time, some enterprise abuse of intellectual property rights has led to aseries of problems, including both domestic enterprise and multinational company. Especiallymultinational company, called for the China government to protect the lawful intellectualproperty rights, but, Multinational companies use knowledge property rights to monopoly, ourcountry law no way to stop to it. This kind of situation hindered the healthy development ofour country’s economy. Other laws is scattered on this problem.China’s anti-monopoly law has just has just introduced, is not perfect, the execution isalso weak. This paper analyzes the relationship between the anti-monopoly law and the abuseof intellectual property rights. This article analyzes using a variety of methods, including theempirical analysis, comparative analysis and historical analysis. The paper recounts the lawsof developed countries, at the same time, based on China’s national conditions, make ourcountry’s law perfect.
