China is a developing country with large population but less farming land, however, land is the mother of wealth. Housing land, to the members of rural collective economic organization, is of more property value. As China implements public-owned land system, under which rural housing land belongs to the collectivity, and transactions of the land ownership are prohibited, it has become impossible to establish the rural real estate market based on the ownership of housing land, then, this historic task shifts to usufruct in rural housing land. In real life, it has become common to transfer usufruct in rural housing land, especially in rural area coalescent to cities and rich in natural landscape. But this hidden spontaneous circulation market is lack of legal norms and full of problems.This paper, based on investigation study method, has made a legal analysis on the transfer of usufruct in rural housing land. It is structured in the way of'putting forward the question- analyzing the question and getting the conclusion. First, definitions of the key words are given. Then, the current circulation situation is analyzed on the basis of the graphics attained through investigation, followed by the problems in the circulation market. Next, the author offers the reasons on the above problems. In the end, it is reached the conclusion of establishing the circulation system through gradual transferring mode on the basis of full analysis. Meanwhile, the establishment and improvement of relevant systems should be strengthened to standardize and guide this hidden circulation market, in order to coordinate urban and rural development and protect the interests of farmers.
