As society progresses, public welfare becomes more and more complex. The minor custody has become the responsibility of not only families but also governments. Government has begun to play critical roles in providing monitor, remedy, and service for minor custody. As a result, the roles of government can entitle minors without sufficient parental custody to proper care and protection. In addition, these roles can make all minors able to equally benefit from the services provided by government. This is the correct direction to reform and improve minor custody system to protect the legal rights of minors.There are several defects with our current minor custody system like over-relying on parental control, and lack of government involvement. Government did not make proper systems for minor custody. These systems include monitoring policies, monitoring organizations, financial assistances, execution plans, and services. Without government involvement, some phenomena in minor custody in China are uneasy and harrowing: accidental injure of minors due to lack of proper custody; addiction to internet; minor criminal; infringement of legal rights if minors; inequality in participation right.This thesis reveals the deficiency of government involvement in monitoring minor custody and provides some suggestion for improvement on government roles in order to protect the legal rights of minors in China.The first chapter describes the values of this topic and briefly summarizes the results of literature review. This chapter defines several major concepts used in this thesis including minor, minor custody, government role. This chapter also briefly describes research approaches.The second chapter, from aspects of protecting minor legal rights and developing monitoring system for minor custody, reveals that the minor custody has changed to part of the public welfare from an internal affair. Since China excessively relies on family roles in minor custody, minors can not obtain sufficient protection for their legal rights.The third chapter finds, through study on the current system of minor custody, that there are deficiencies in government roles including monitoring policies, organizations, financial assistances, execution plans, and services.The fourth chapter studies the defects and negative impacts of the current minor custody systems without sufficient government involvement using methods of investigation and case study. Through qualitative and quantitative analyses, this chapter indicates that minor custody needs government participation and it is necessary for governments to reform and improve the current government roles in minor custody.The last chapter provides some suggestions on improving government roles: establishing government monitoring polices; setting up policies to maximize minor benefits; reforming government monitoring system; securing financial assistance; clearly defining execution plans; expanding service areas.
