A Research Study On The Student Appeal System For China's Universities

As the construction of the social legal system progresses and law consciousness among citizens strengthens, many students are dissatisfied with the punitive system that the schools utilize. Thus the number of cases that students bring up to appeal with educational administration increases continuously. Some cases have even drawn the attention of the entire country.Among the new codes for maintaining the students' legal rights ,the establishment of the students' appeal system is the most remarkable. However, currently only a small number of researchers are carrying on a deeper investigation into this system within our country. First of all, through analyzing the basis of the theory and reality, the thesis affirms the necessity and urgency to carry on an investigation into the students' appeal system. Secondly, during the research process, the concept, property, and characteristics of the students' appeal system become more clearly defined; the subject, the content, and the object are further analyzed. The significance and the function of this system are emphasized. On this basis, we have respectively investigated both the entity system and the procedural system.The entity system is mainly expounded and analyzed from the aspect of the management mechanism, the conditions under which the students can institute an appeal and the rights and obligations of all parties during the appeal process. The procedural system deals mainly with initiating, directing, and controlling i.e. evaluating this system. Consequently, we would gain greater proficiency in the overall effective and equitable utilization of this system.The establishment of this system is an internal requirement which colleges push forward to manage a school according to law, as well as to implement a systemized, normalized, and proceduralized democratic management system. In addition, it is also an important guarantee in respecting students' rights and maintaining students' interests and school loyalty and respect. The second half of this paper analyzes the practical actuality, existent problems, and the problems in promoting this system, and then puts forward rationalized suggestions with respect to consummating this system.
