Study On The Legal Liability Of The Administrative Guidance

Administrative guidance is the important recovery method of process on the market failure and government intervention failure in the modern market economy. At present, the administrative guidance has been widely applied in all the fields of administration and will gradually become the center of administration instead of administrative order. The socialistic market economics system is being made, the degree of politics democracy is being improved. The function of administrative guidance is becoming stronger in administrative management in China. The development of the socialistic market economics system and politics democracy will be influenced by the perfect administrative guidance system.This paper falls into four parts to discuss. Part one is the foreword. The focus of this part is to introduce the basic of administrative guidance and the writing technology of the paper. Part two is the brief theory of the administrative guidance, which including the concept, the nature, the classification, the history and the movement foundation of administrative guidance. Part three is the brief theory of the legal liability of the administrative guidance, which including the concept, the characteristic and the necessity. Part four is the inspection to some overseas'experience, then choices administrative guidance in Japan, the USA and German. Part five is trying to build a system of the legal liability of the administrative guidance in China.
