Analysis On Cost And Utility Of Administrative Legislation

The analysis on cost-utility of administrative legislation is to analyze this problem from the perspective of economic analysis law. This method focuses on the cost-utility in order to make the resources of administrative legislation configure optimally and the benefit administrative legislation maximize. This is a new point of view that the principles of economics as a tool to prove and explain the administrative legislation. The scientific analysis of the cost-utility on law can improve legislative efficiency and make the administrative legislation more perfectly. And it also can make it more scientific and practical so as to achieve the objectives and values of the administrative legislation.The title of this paper is Analysis on Cost and Utility of Administrative Legislation——for the example of administrative legislation in Qingdao. This paper uses the relative theories and methods of economic analysis law and focuses on the cost and benefit of administrative legislation. Furthermore, it carries out the demonstration analysis combined the administrative legislation of Qingdao and points out a series of methods aim to the specific conditions of Qingdao. This paper is divided into four chapters, as follows:Chapter 1:"the introduction of Administrative Legislation cost-utility analysis system" This chapter deals primarily with economic analysis from the perspective of cost-utility analysis about administrative law on the theoretical basis. Then the connotations and compositions of administrative legislation cost and benefit are analyzed in detailed conditions.Chapter II: "the need of China's administrative legislation on cost-utility analysis". This chapter will primarily solve why we should analyze China's administrative legislation on cost-utility. First, this chapter briefly introduces the meaning, basic status and achievements of China's administrative legislation. Second, it focuses on the need of cost-utility analysis of administrative legislation in our country. On the one hand, the United States, Australia and other countries have succeeded in cost-utility analysis of administrative legislation. And this enlightens the author's thinking quietly. On the other hand, China's administrative legislation has serious drawbacks: high costs and low returns. It shows that lagging performance in administrative legislation, the high cost of time in legislation, the high external costs and opportunity costs of the administrative legislation and the descending marginal gains. Finally, this chapter represents the value and significance of the paper from theoretical and practical aspects.Chapter III "the demonstration analysis on cost-utility of administrative legislation in Qingdao ". This chapter surveys the administrative legislation of Qingdao on the spot and analyzes the results of these instances. The methods in existence and effectiveness of these are analyzed in this chapter. On the basis of this, the author analyzes the shortcomings of cost-utility analysis of administrative legislation in Qingdao. Furthermore, the author points out that these shortcomings affect the quality of administrative legislation of Qingdao.Chapter IV, "the countermeasures and suggestions on cost-effectiveness analysis of administrative legislation in China" This chapter focuses on how to establish and improve our cost-effectiveness analysis system of administrative legislation on in our country. And in this chapter the author bring forward six countermeasures from the administrative legislation in our country and referring the advanced system and the successful practices of Western countries. These includes : the improvement of administrative legislation planning system; Strengthen the administrative legislation to improve our establishment; the establishment and improvement of public hearings in administrative legislation process; rational distribution and efficient use of our resources administrative legislation; Speeding up of the administrative legislation evaluation system; improving our supervisory mechanism to strengthen the administrative legislation. To shortcomings of China's administrative legislation in existence this chapter explains the feasible improvement programs; To the system that has not yet adopted in administrative legislation, the chapter focuses on the system expounded the significance of role and content of the briefing, and in keeping with China's actual conditions and the introduction of the program.
